Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the LUMA website and AI photo editing tools at lumatools.co (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

LUMA provides AI-powered photo editing tools including image enhancement, relighting, retouching, style transfer, background removal, upscaling, and image expansion. The Service is operated by LUMA ("we", "us", "our").

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.

3. Accounts

3.1 Registration

Some features require an account. You may sign up using email, magic link, or passkey authentication. You are responsible for maintaining the security of your account credentials.

3.2 Account Accuracy

You agree to provide accurate and complete information when creating an account and to keep it up to date.

3.3 Account Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms.

4. Free and Paid Plans

4.1 Free Tier

The Service offers 3 free edits per day per tool. Free edits are available without an account (rate-limited by IP address) or with a free account. Free edits produce the same quality output as paid edits — no watermarks or quality reduction.

4.2 Paid Subscriptions

For unlimited edits, you may subscribe to one of our paid plans:

  • Weekly plan: $4.99 per week
  • Monthly plan: $9.99 per month

Prices are in USD and may be updated with 30 days' notice. Applicable taxes may be added at checkout.

4.3 Billing and Renewal

Subscriptions are billed in advance on a recurring basis (weekly or monthly). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not offer prorated refunds for partial billing periods.

4.5 Refunds

If you are unsatisfied with the Service, you may request a refund within 7 days of your initial purchase by emailing support@lumatools.co. Refunds are not available after the 7-day window or for renewal charges.

4.6 Payment Processing

Payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service. We do not store your full payment card details.

5. Your Content

5.1 Ownership

You retain full ownership of all images you upload to the Service and all edited images produced by the Service. We claim no intellectual property rights over your content.

5.2 License to Process

By uploading an image, you grant us a limited, temporary license to process that image solely for the purpose of performing the requested edit. This license terminates when processing is complete.

5.3 No Storage

We do not permanently store your images. Uploaded images are processed in real time and are not retained on our servers after processing. Temporary URLs for edited images expire within 24 hours. See our Privacy Policy for details.

5.4 Your Responsibilities

You represent and warrant that:

  • You own the images you upload, or have the necessary rights and permissions to edit them.
  • Your images do not infringe on the intellectual property rights, privacy rights, or other rights of any third party.
  • Your images do not contain illegal content.

We reserve the right to refuse processing of any image that we reasonably believe violates these Terms.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload images containing child sexual abuse material (CSAM) or any exploitative content involving minors.
  • Use the Service to create non-consensual intimate imagery or deepfakes of real individuals.
  • Attempt to circumvent rate limits, authentication, or other security measures.
  • Use automated scripts, bots, or scrapers to access the Service in bulk.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Resell, sublicense, or redistribute the Service or access to it.
  • Interfere with or disrupt the Service or its infrastructure.

We may suspend or terminate your access immediately and without notice if you violate this section.

7. AI Processing and Limitations

7.1 AI-Generated Output

The Service uses third-party AI models to process images. AI output may vary in quality and may not always meet your expectations. We do not guarantee specific results.

7.2 No Human Review

Images are processed automatically by AI. We do not manually review the content of images you upload or results you receive, except where required by law or to investigate reported abuse.

7.3 Third-Party AI Providers

Image processing is performed by third-party AI providers (fal.ai, Replicate) under our data processing agreements. These providers process images solely on our behalf and do not retain your images for their own purposes.

8. Intellectual Property

8.1 Our IP

The Service, including its design, branding, code, and documentation, is owned by LUMA and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

8.2 Feedback

If you provide feedback or suggestions about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • AI-processed results will be accurate or meet your specific requirements.
  • Defects will be corrected in any particular timeframe.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or death/personal injury caused by negligence.

11. Indemnification

You agree to indemnify and hold harmless LUMA from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Consumer Rights (EU/EEA)

If you are a consumer in the European Economic Area:

  • These Terms do not affect your statutory consumer rights under applicable EU law, including rights under the Consumer Rights Directive.
  • You have the right to withdraw from a digital content purchase within 14 days, unless you have expressly consented to the performance of the service beginning before the withdrawal period expires and acknowledged that you lose your right of withdrawal.
  • By starting to use a paid subscription, you consent to immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully performed.
  • Any disputes may be submitted to the European Commission's Online Dispute Resolution platform.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions. However, if you are a consumer in the EU/EEA, you retain the protection of the mandatory provisions of the law of your country of residence, and you may bring legal proceedings in your local courts.

14. Changes to These Terms

We may modify these Terms from time to time. We will notify registered users of material changes via email at least 30 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LUMA regarding the Service.
